Judge Napolitano in the video link below agrees with Dr. Rex Curry that the USA Pledge was the origin of the Nazi salute. Another link shows another video (on Youtube) in which a harassed student (in a government school / socialist school with daily chanting) also agrees with what Curry has been saying for a decade or more: that the USA Pledge was the origin of Nazi salute. Francis Bellamy was the author of the Pledge of Allegiance and the origin of the Nazi salute that was used in the early pledge's ritualized daily chanting / brainwashing. They repeat it as if it is serious, rational and important. That is what happens to "news" media in a police state. The Tribune is collapsing under the internet and under Dr. Curry's internet work (taking top spots on the web for exposing Silvestrini, Ruth and the Tribune). Silvestrini and Ruth are learning the hard way why the Tribune is losing under the web. Similar resullts show in searches for Daniel Ruth. Videos expose them in the top spots in searches on Youtube.com for Elaine Silvestrini, Daniel Ruth, and Tampa Tribune. As a career move, Elaine Silvestrini should not become a lawyer. Her "journalism" might cause some people to wonder if she is competent even to write about legal issues, or to write at all about anything. Recently when Silvestrini wrote again about "high-profile drugs, sex and torture," Silvestrini mentioned Dr. Curry, and his appellate work as an attorney for a defendant in whom Silvestrini has taken an ongoing interest. As expected, Charles Rose apparently did not think he was up to it as Charles Rose has not selected a time or place in response to Dr. Curry's public debate challenge.

Even after Elaine Silvestrini printed the debate challenge to Charles Rose in the newspaper, there was no response from Rose that Silvestrini printed in the article. It remains another media debate challenge victory for Dr. Curry over Charles Rose.

It is telling to note that a google search reveals a web page on the Stetson Law School web site where Charles Rose (or someone for him) keeps a running list of the relationship between Silvestrini and Rose by synopsizing articles where Silvestrini repeatedly uses Rose.

Only Ruth's phone number and email address were given with no biographical or background information (nor any link to such information). There is a complete lack of disclosure of whether Ruth has any licensing or educational acheivement that qualifies him to write on such a topic, how he was selected, nor how much Ruth was paid to write the piece (It might embarrass him if they printed what he was paid). Ruth learned to write in government schools on Planet Zircon 9.

As a career move, Daniel Ruth should not become a lawyer. His "journalism" might cause some people to wonder if he is competent even to write about legal issues, or to write at all about anything. If Ruth is considering a career change to law then here is a Memo to Daniel Ruth: Don't start packing your bags.

Ruth's employer, the Tampa Tribune, is a so-called newspaper that has never published a historical photograph of the Pledge's early stiff-arm salute, nor printed an article about the Pledge's relationship to the salute of the National Socialist German Workers Party, its symbol and its rituals. In that way, the Tampa Tribune promotes and perpetuates flag fetishism by repeating the tired cliches through touch-holes such as Ruth. Now Ruth can no longer use the defense of unintentional ignorance, as he might have in the past.

Ruth remained unable or unwilling to state the simple issue: The Pledge of Allegiance (and its author) was the origin of the salute of the National Socialist German Workers Party and influenced its symbols and rituals. Ruth is a denier and a historical revisionist. Is Ruth dense or does lack of integrity and honesty make him unwilling to provide simple accurate reporting?

Ruth failed to discuss nor even enumerate the six or more issues that Curry's appellate brief argued on behalf of the defendant in the case. Ruth has the ability to let his audience decide for themselves because Ruth could post Curry's brief on the web site of the Tampa Tribune or TBO.com, but Ruth did not do so and will not do so because the brief would expose his inane comments, omissions and cover-ups.

If you read newspapers for years then you will see all manner of ditzoid craziness that slops its way over the journalistic gunwales -claims of UFO abductions, the conspiracy theorists, Nazi cabals, deranged threatening environmentalists and people who believe monkeys are taking over the world. And those are just some of the serious news stories.

There are some newspaper writers, too, who are really weird. Take Daniel Ruth. Please, take him.

For all the black helicopter sightings and arguments Shecky Green and the Jewish lobby control the government and Y2K means the end of the world, Daniel Ruth has to be not only the most certifiably insane, but perhaps the most twistedly evasive.

The Felliniesque Fidel Castro never answered any of the original questions. For example, why is the federal government growing so large, taking over criminal law nationwide, and becoming involved in what in the past would have been state level cases? Daniel Ruth - a "newspaper" writer - weighed in with one long sputtering bluster against historical reality. Loopy Ruth did his usual mental blank-out. The Karl Marx of the Twilight Zone responded with a bunch of journalistic babble and name-calling that is his "trademark."

Ruth is one of the most visible local disciples of the Tampa Tribune, which ought to have his embarrassed fellow travelers donning Groucho Marx disguises around the office and about town.

You have to wonder what schools Ruth went to. Government schools? The government taught him everything it knows and he is still stupid. But that is statist quo.

Ruth a writer with a big public forum and his reasoning is that of half-baked socialism/statism. Terrifying.

Ruth's remarks are a reminder of the cliche' "If you can't do, and you can't teach, then write."

Ruth knows that the media debate challenge that was issued by Dr. Rex Curry as quoted by another Tribune reporter ( Elaine Silvestrini ), is also available to Ruth and Ruth knows that everyone else knows that Ruth has always been too cowardly to do it over the many years and he never will. The only person Ruth is fooling is himself.

It will always remain another media debate challenge victory for Dr. Curry over Daniel Ruth and the Tampa Tribune.

Ruth's comments raise the question of whether Ruth is unable to recognize any meritorious arguments in the six or more issues raised on behalf of the defendant in the brief. One of those issues was "insufficiency of the evidence" which is probably the most common issue argued in appeals of criminal cases.

Ruth's comments are especially odd considering that similar appellate issues were raised and argued in six issues raised by another attorney in a related case involving Scott Schweickert, charged as a co-conspirator. Was Ruth saying that he would provide ineffective assistance of counsel to a defendant by waiving / abandoning all the issues? Was Ruth saying that Ruth would file an Anders brief for both defendants (in an Anders brief a defense attorney openly states that he believes there are no meritorious issues to argue for a defendant)? Ineffective assistance of counsel is shown primarily by waiving and abandoning issues. Not by having an extra issue that is not victorious. Most appeals are unsuccessful, meaning that all arguments made in most cases are rejected by the appellate court.

Here is other information that was known to Daniel Ruth and that he omitted from his article: The issues raised in Dr. Curry's brief are not uncommon and similar to most of the issues raised in other briefs, such as that of the Defendant Scott Schweikert (for example, insufficiency of the evidence). Some of the issues were also raised in articles in Ruth's newspaper (the Tampa Tribune) about the case and are also supported by comments made by some judges, jurors and other observers concerning the charges, the trial and the sentence (and some of that is in the brief). The issues are also supported by other people such as the former prosecutor Vincent Bugliosi (author of the book "The Prosecution of President George W. Bush for Murder").

It is also consistent with what has been the law historically in the U.S.A.Some of the issues have also met with some success in United States v. Stewart 348 F.3d 1132 (9th Cir. 2003) an opinion by Judge Alex Kozinski (whowill be speaking in Tampa to the Federal Bar Association during the same month as this communication to Silvestrini). Similar arguments were made unsuccessfully in Gonzales v. Raich, 545 U.S. 1 (2005) (the medical marijuana case cited in the government's brief and in Dr. Curry's brief). United States v. Stewart is a case involving a challenge to the constitutionality of 18 U.S.C. § 922o under the Commerce Clause of the United States Constitution. The United States Court of Appeals for the Ninth Circuit ruled that mere possession of homemade machine guns can not be constitutionally regulated by the United States Congress under the Commerce Clause. Upon granting certiorari, the Supreme Court of the United States vacated the Ninth Circuit's ruling and remanded the case back to the court for further consideration in light of its ruling in Gonzales v. Ruth's inability to undertand the jurisdictional argument on appeal (that the federal government lacked jurisdiction in the case) is bizarre in light of the May 1, 2007 article in the Tampa Tribune reporting that Judge Merryday "...said the federal government is 'not situated to prosecute the real offense, which prosecution is situated in the state of Florida.' "

The Tampa Tribune also wrote, regarding Curry's client: "In sentencing Lorenzo last year, U.S. District Judge Richard Lazzara said that if he were a circuit judge [state level] and the prosecution had brought capital murder charges, the government would have no trouble establishing the presence of four aggravating factors - facets of the case legally required for a death sentence."

Ruth is guilty of ineffective assistance of reporting.It is no wonder why old-style "newspapers" such as Ruth's are dying out as people turn to the internet for more accurate information.

The poor and the wealthy hurt by the storm.
Black, White, Hispanic, Oriental and Indian all hurt by the storm.
Christian people giving, giving, giving.
Churches going all out to minister in Jesus' name.
Neighbors going door to door helping one another.
Thugs and hoodlums going door to door looking for someone vulnerable.
Ice and water being fought over as police tried to keep the peace.
People coming up from New Orleans taking over empty houses because shelters are full.
Out of town volunteers coming with food and staying for now a week still serving it.
The Churches all over this part of the country doing what Christians do in a crisis.
FEMA doing a wonderful job in getting help to us.
The Red Cross doing a great job in the shelters.
The Salvation Army doing a great job in the community.
Four Hundred crewman from everywhere bring back the power to our homes, churches and businesses.
Lines at service stations a block to a mile long National Guardsman patrolling the streets of McComb along with Kentucky policemen protecting us from the hoodlums and
thugs of McComb, Pike County and New Orleans (the most dangerous city in the world before Katrina.)
Drug dealers working outside shelters.
Doctors, nurses and other hospital personnel working tirelessly, even sleeping in the hospital to do the job God called them to do.

WHAT I HAVE NOT SEEN:

The ACLU setting up a feeding line.
People for the American Way helping in the shelters.
The NAACP doing any work whatsover.
The American Atheist organization serving meals in the shelters.
Jesse Jackson directing traffic at the gas stations.

I could go on but you get my message. It’s the Christian people with love and compassion who do the work. The gripers in Congress should come on down
and get in line to pass the water and the ice. Are you listening Hillary, Chuck, Teddy and all the sorry loafers we call Senators and Congressmen. They don't
have a clue as to what this life is all about here on the gulf coast.

Tribune Hyprocrisy and Daniel Ruth

Ah, the self-righteous hypocrisy of the editorial staff of the Tampa Tribune--again. In the Saturday, September 24, 2005 edition the Tribune lectures its poor hapless readers with a list of six ways to “Saving Fuel”. Now mind you none of us could have ever reached the conclusion of the Tribune on our own that turning off a light when leaving a room could save fuel. But now that the Tribune quivering lips have enlightened us the light in our brains suddenly comes on. (Oops! We must turn that light off in our brains to save even more fuel!)

So where is the hypocrisy? Well in the same issue the Tribune published an article in the “At Home” section, replete with color photographs, an article titled “Legacy on the Lake”. This article extolled the palatial digs of Emilio Dominguez and Lowella Esperanza on Egypt Lake. Not one word was mentioned in this article of the editorial staff’s perceived excesses of a 6500 sq. ft. living area and the additional 3500 sq. ft. add-ons. How much energy and resources have been concentrated into just one home that houses just one family? Where was the Tribune’s indignation about those excesses that are so obvious in the article? Well, there was not one comment!

Does this mean that I take issue with the amount of money and resources that these people put into their home? Certainly not! It’s their money and they can spend it in the manner which they decide.

My issue is with a newspaper that would lecture the great unwashed to “limit unnecessary trips” and then publish an article about opulence—all in the same issue. For next week’s lecture is the Tribune going to publish a list of unnecessary trips so that we, the unconcerned and uncaring, will know the difference between necessary and unnecessary trips? Perhaps you can turn the task over to that lover of humanity hack Daniel Ruth which you employ as the Tribune’s alter ego!

I know that it may be a shocking revelation to the Tribune editorial staff to realize but your readers are not as uninformed and inept as you indicate in your “Saving Fuel” editorial.

These are some names that TBR used to describe Hillsborough County Florida commissioner Jim Norman.  I don’t follow Mr. Norman’s political activities all that closely but I know he has been elected several times by his low life constituents (in TBR’s opinion) so he apparently does some things that they like.

TBR goes on in his article to make this statement, “Ironically, one of Norman’s biggest boosters was none other than ultraconservative gadfly blowhard Ralph Hayes who collects politicians like so many charm bracelet trinkets.”   Did you catch that folks?  TBR actually called somebody else a blowhard.  Look at all the name calling he has done down through the years and then fancy him calling someone else a blowhard.  This yellow shirted cubicle denizen could open his own university and offer advanced degrees in the art of blowing.

This guy fancies himself to be a modern day Will Rogers.  But what he actually turns out to be is the Tribune’s alter ego hack that is a neurotic coward hiding out behind a word processor keyboard.

A Concert Experience To Die For? (9/18/05)

With each column Tribune attack dog Daniel Ruth manages to display his hypocrisy in a new way. In today’s column he speaks of the two participants in a recent Tampa Ybor City nightclub incident in which one man was stabbed to death by the other. Ruth goes on to say, “If only Laskas had been given an extra 20 minutes of life, he and Payne might well have wound up having a beer together—and two futures would have been spared.”

All of this compassion from a man who has made a career of penning incessant name-calling columns filled with hate speech. A man who has an attitude of, “It’s me against them and it doesn’t matter who ‘them’ happens to be”. A man who goes out of his way to impress upon others in the community as to how little regard he has for their attitudes, opinions and viewpoints. And all of this has been accomplished under the aegis of the Tampa Tribune, which, in itself, has become the “paradigm of hypocrisy” in Florida newspapers.

Through his columns Ruth has helped create an atmosphere of incivility in the community. Is it any wonder that victims of his bile take notice of his disregard for them?

Is Ruth so naïve that he can’t make the connection between his own incivility and the incivility that might be found in a Tampa nightclub? I think not! It’s hypocrisy on display—pure and simple

Just Give Us The News (September 17, 2005)

Just Give Us The News (September 17, 2005)

It’s not enough that the Tribune editor has the front page and the editorial section to present the news as she sees it.  Now she’s taken over “Citizen’s Voice” besides!

As for her former editor who told her it was wrong for journalists “to use objectivity as a shield to separate us from the stories we write,” he gave her bad advice.  We, the newspaper readers, don’t buy papers to find out what to think or to be told how to interpret the news.  Give us the news and we’ll take it from there.  Besides, once a reporter lets passionate belief overcome objectivity, the line between news and opinion is inevitably blurred and the subscriber soon discovers he cannot depend on his paper for reliable information,

In today’s world, with so many other sources of information available, that reader may choose to become a former reader.

"On today’s op-ed page (9/13/05) you wax indignant and declare that Barbara Bush should apologize for her remarks about the New Orleans slums. This was done in an unsigned editorial. But then, on the other hand, the Tribune enables its resident attack dog Daniel Ruth to accuse the President of being a murderer when he said, "The body bags stop at the Oval Office”. My, my! Aren’t you folks just a fine kettle of hypocrites down there on Parker street!"

TBR - The Man Who Never Met A Man (Or Lady) He Really Liked.

Interesting headline on TBR’s column this morning.  (Thank Gawd The Niceness Has Ended!!! 912/05)  Since he doesn’t believe in God he has to thank Gawd.  Why would he feel the necessity to thank himself in public?  He lambastes the Tampa City Council members and trashes the entire Hillsborough County Commission as being, “…more dysfunctional the cast of ‘Curb Your Enthusiasm.’”

He wants to say some good things about Mayor Pam but just can’t bring himself to do so.  He says that Mayor Pam, “..has probably never given so much as a nano-second to contemplating the governor’s mansion.”  We’ll see about that one.   You can be sure that Mayor Pam  has given and is giving a lot of thought to the governor’s digs!!

Anyway this column was boring and was much ado about nothing.  But it did show us, once again, that TBR is a man who has never met a man (or woman) that he really liked.  No one knows this better than his family members.

Handicapping Blame Game Point Spread 9/9/05

Well, folks, we’ve been waiting for this article and he finally came through. I urge to read the Tribune screed from TBR today. Nothing exemplifies the true nature of this Tribune flounce. In this article he hurls vindictive insult after vindictive insult at good people who are trying to deal with a monumental national disaster.

Not once—no not even once--did he offer even the slightest suggestion as to how to best heal the wounded souls in the Katrina aftermath. Did he get off his tubby posterior and go up and help? Nah! That’s far beneath his view of his importance. Besides, he can’t get that far away from his favorite Whopper palace. Instead he sits in his cubicle down at the Mommy Trib munching on his Twinkies and mentally masturbating himself. He does so by impugning the integrity of good people whose only fault is that they do not share his grand view of the universe. This man has been invaded by a dark and empty soul. It is beyond me how the Tampa Tribune continues to harbor his venom. But, on the other hand, maybe I shouldn’t be surprised at all. Do ya think!

Letter to Tampa Tribune Aug. 19, 2005

Clausewitz of Skull and Bones, MacArthur of Arbusto, Wellington of Waco, Commander-In-Sleep Patton of Kennebunkport and Robert E. Lee of the Beltway. These are the phrases Daniel Ruth used to describe George W. Bush in his Tampa Tribune column of August 19, 2005.

In recent months Ruth has used similar, but more robust language, to rail against radio talk show hosts Sean Hannity, Glenn Beck and Rush Limbaugh. All three of these men have highly successful radio programs that are broadcast nationwide. Meanwhile, Ruth has a radio talk show program on a local radio station on Saturday morning. His program has absolutely no ratings. There wouldn't be any professional envy involved in his disdain for his competition would there? Naaah!! Ruth is much too liberal and loving to be envious of successful people--or is he?

The Tribune (and Ruth) describes Ruth's harangues as merely a writing style. But it is obvious that it is much more than a writing style. It is a mask for a man who truly hates and despises those people that with whom he disagrees. His anger is manifested in print under the aegis of the Tampa Tribune.

Ruth clearly deals in hate and may be fomenting retribution in the minds of some of his more unstable readers and listeners. Sounds far-fetched? Well, people with high levels of frustration, such as Ruth, have been known to use drastic methods to bring harm to their imagined enemies! Responsibility for the acts of retribution on Ruth's imagined enemies performed by someone as a result of Ruth's vitriol will, also, accrue to the Tampa Tribune.

The Tribune might be well advised to consider psychiatric evaluation of Ruth who is clearly unstable and dangerous.

In this column ole TBR is thumping the walls of his cubicle again. He takes on the runaway bride Jennifer Wilbanks problem—and solves it.

In this column, speaking for Jennifer Wilbanks, he states, “I’m about to enter into a lifetime commitment with a nice guy maybe, but I don’t feel like waking up next to Jed Clampett for the next forty years.” TBR doesn’t think very much of the Jed Clampett or the Gomer Pyle types of the world. In his own words he thinks the rest of us are “,,,,(the public is) more gullible than a Muppet.” Aw, shucks, he doesn’t even think very much of his own twenty-two year old son’s brains. No matter that in the end Gomer and Jed always managed to outsmart fat guy types wearing yellow shirts.

You see folks, the Socialists/Liberals of the world like TBR view the rest of us as pretty much undeserving of our place on the planet. But, since we are here, we need them to show us the joys of cynicism and arrogance.

A few months back TBR had bypass surgery to correct years of oinking. The rumor is that he is writing a book that he will title “My Infallible Method For Avoiding Bypass Surgery”.

Today's column? Booooring. Man, what was that all about? About the only thing going on in that column was the expression of his willingness to become Mayor Pam's butt-boy.

And his misuse of the language when he states, "...focusing on the 100-year-old vacated federal courthouse building....". Huh? Has the court house been vacated for a hundred years? Or did he mean to say the “vacated 100-year-old courthouse”? For a man that is very impressed with his word processor rants one would think he could command the language a little better. Oh well, the Trib wouldn’t have hired him if he had real journalistic skills.

In today’s column TBR exposes to us what he, and all socialist/liberals, think of the rest of us. In his column he makes the statement, “All this folderol over the constitution could have been avoided if: A) the Florida Legislature did its job and/or B) the public wasn’t more gullible than a Muppet.”

There you have it. If the public agrees with them they (the public) are wise and insightful. If, however, they don’t agree with them they are “….more gullible than a Muppet”. This statement goes to the heart of what Socialism/Liberalism is all about. They truly believe that the common man is too stupid to govern himself through democracy and free enterprise. Only socialism with its elite ruling class is capable of governing. Only they have access to morality with its changing tides.

This is why TBR stays in a constant snit. He constantly calls those who disagree with his point-of-view names of disparagement. He calls it a “style of writing”. He even refers to himself as the “Mahatma of Metaphors”. But folks, it’s nothing more than cowardice in its purest form. He hides in his cubicle and flails away at his word processor. Now I know ole TBR won’t mind being called a coward. After all, it’s just a style of writing.

Well, boy and girls in today's Tribune article TBR finally reveals to us why he is so angry so much of his life. He devotes four whole paragraphs of his article telling us how his first grade experience warped his entire existence. It seems that Sister Mary Dahmer (no doubt Jeffery’s sister also) at the St. Sebastians intimidated him so much that the experience carried over to the fifth grade--which he flunked. Folks, the nuns paddled his widdle butt. Imagine what a military boot camp would have done to this guy! Such a man!!

Folks doesn't this guy remind you of the fat guy in the Capital One TV advertisement wearing the yellow shirt? He shrieks and runs when he thinks he is going to get his butt whipped? Ole TBR just hides in his cubicle down at the Trib and flails away with his word processor. I'll bet he even wears yellow shirts to work.

In his article TBR even takes on the Rev. Al Sharpton. Now ole Rev. Al is a true soul mate of TBR in philosophy. But today TBR was a little more angry than usual and he just struck out at the first person that came to mind. He will probably apologize to Rev. Al privately.

Who Was The Real Threat To The Town?

In today's (April 27, 2005) Tampa Tribune column TBR starts his column by saying, "For starters, let's get all of the yahooesque demagoguery out of the way." This is TBR's way of saying that anyone that has a opinion about any situation that differs from his own is a "yahoo".

TBR describes a situation where a convicted child molester in Marion County, Florida named Clovis Claxton, (who really wasn't all that bad) killed himself after being hounded by Marion County Commissioner Randy Harris. TBR then states that Commissioner Harris is a bigger risk to the community than the molester Claxton could ever be.

He goes on to describe the people of Marion County Florida as being "a frothing lynch mob".

Now folks, if you ever wandered what the word "demagoguery" means just check out TBR's writing style. It's just another example of the underlying spite in his nature. A "frothing lynch mob" indeed!

His Kid is Flying Airplanes

On Saturday April 16th during TBR's goofy radio talk-show program on WFLA he was ranting to one of his nine listeners. The caller was trying to state his view about how personal saving accounts in Social Security could be a good thing. TBR flew into a rage and told the caller that he had a twenty-two year old son that was an airline pilot. He went on to say that his son wouldn't have the faintest idea as to how to manage a private account. I think he was trying to say his son wasn't too smart. Folks, this kid is flying people around in airplanes. You better check out who is doing the steering before you get on your next flight.
